1. Who we are
MailChecked is operated by the entity behind mailchecked.com ("MailChecked", "we", "us", "our"). Use of the service is subject to these Terms.
2. The service
MailChecked is an email-validation platform that classifies email addresses as Valid, Invalid, Catch-all, Risky, or Unknown using a combination of syntactic checks, DNS/MX lookups, SMTP probing, historical bounce data, and provider-specific signals.
3. Account, eligibility, and security
- You must be at least 16 years old (or the age of majority in your jurisdiction) and able to form a binding contract.
- You are responsible for keeping your credentials and API keys confidential. Treat API keys like passwords.
- You are responsible for all activity under your account, including any sub-users or automation you authorize.
- You must verify your email address. We may suspend unverified accounts.
4. Credits, billing, and fees
- The service is sold on a pay-as-you-go credit basis. Credits are consumed when a definitive verdict (Valid, Invalid, Catch-all, Risky) is returned. Unknown verdicts and cache hits are free.
- One verification = one credit (regardless of how many internal pipeline stages run).
- Credits never expire while your account is in good standing.
- Top-ups are billed via Stripe. We don't store your card details.
- Prices are in USD and exclude any local taxes. You're responsible for taxes that apply in your jurisdiction.
- We may change pricing for future top-ups with 30 days' notice; previously-purchased credits keep their original cost basis.
5. Refunds
See our Refund Policy. In summary: unused top-ups are refundable within 30 days; addresses we mark Valid that hard-bounce within 14 days are refunded automatically.
6. Acceptable use
You must comply with our Acceptable Use Policy. In particular, you may not use MailChecked to support spam, phishing, harassment, fraud, or any unlawful messaging activity. You must have a lawful basis to validate any email address you submit.
7. Your data
- You retain all rights to email lists you upload. We don't sell, rent, or use your lists for our own marketing.
- Bulk uploads are stored for 30 days so you can re-download results, then permanently deleted.
- We maintain a hashed, anonymized cache of validation results to make repeat checks free for you and to improve accuracy. See our Privacy Policy for details.
- Data processing performed on personal data you submit is governed by our Data Processing Agreement, which is incorporated by reference.
8. Service availability
We aim for 99.9% monthly uptime but do not provide a contractual SLA on the standard pay-as-you-go plan. SLA-backed support is available on request for high-volume customers — contact us.
9. Accuracy and "no-bounce" claims
We publish a target accuracy of ≥97% on the Valid verdict. Email deliverability depends on factors outside our control (sender reputation, content, recipient mail-server behavior, bounce-back delays). Our refund guarantee on hard-bounced Valid results is your sole remedy for accuracy failures.
10. Suspension and termination
We may suspend or terminate accounts that violate these Terms, the Acceptable Use Policy, or applicable law; that we reasonably suspect of fraud or abuse; or that fail payment after a reasonable cure period. You may close your account at any time from the dashboard. Unused credits are refundable per the Refund Policy.
11. Intellectual property
MailChecked, the MailChecked name and logo, the API, the website, and all underlying software remain our property. You receive a non-exclusive, non-transferable, revocable licence to use the service per these Terms.
12. Warranty disclaimer
The service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties — express, implied, statutory, or otherwise — including merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or related to the service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost revenue, or lost data.
14. Indemnification
You will defend and indemnify MailChecked against claims arising from (a) your use of the service in violation of these Terms or the Acceptable Use Policy, (b) your violation of any law, or (c) your infringement of any third-party right.
15. Changes to these Terms
We may update these Terms. Material changes are notified by email and take effect 30 days after notice. Continued use after the effective date constitutes acceptance.
16. Governing law and disputes
These Terms are governed by the laws of the jurisdiction where MailChecked is registered, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction unless mandatory consumer-protection law provides otherwise.
